Uncontested no-fault divorce in every county in New York. From our Williamsville office, we serve clients statewide — remote-friendly, with no physical offices elsewhere. See the statewide section below.
Divorce — Contested & Uncontested
We represent clients in both contested divorces, where spouses disagree on custody, support, or property, and uncontested divorces, where they agree on all terms. We help you understand grounds, filings, negotiation, mediation options, and when court involvement is necessary.
Child Custody & Visitation
Legal and physical custody, parenting time schedules, relocation issues, and modifications. New York courts decide custody based on the best interests of the child; we help present a clear, child-focused plan.
Child Support
Support under the Child Support Standards Act, including income calculation, add-on expenses (health insurance, childcare, education), enforcement, and modification when circumstances change.
Spousal Maintenance
Temporary and post-divorce maintenance (often called alimony) under New York's guideline formulas, as well as negotiated arrangements tailored to income, length of marriage, and need.
Equitable Distribution
New York divides marital property equitably — fairly, not necessarily equally. We address homes, bank and retirement accounts, businesses, professional licenses, and marital debt.
Prenuptial & Postnuptial Agreements
Drafting, review, and negotiation of agreements that define property rights, protect businesses and family assets, and reduce uncertainty — with full disclosure and independent counsel for enforceability.
Criminal Law — DWI Defense (Western New York)
Criminal and DWI matters at Santoro, Carr PLLC are handled by Jeffrey P. Santoro. We help clients facing driving while intoxicated (DWI) and related charges under New York Vehicle & Traffic Law § 1192 in Western New York, including Erie County — the county where the arrest occurred controls the court and DMV process. A DWI case involves both a criminal case and a license case, often on a fast timeline: arraignment, possible prompt suspension at arraignment, and, if you refused a chemical test, a DMV refusal hearing. Early guidance can matter for deadlines, hardship or conditional driving privileges, ignition interlock, and negotiating or litigating the charge.
Our statewide coverage is for uncontested no-fault divorce; criminal / DWI work is focused on Western New York. General information only — not legal advice.

The NY No-Fault Uncontested Process — At a Glance
- Grounds: One spouse states under oath the relationship has been irretrievably broken for at least six months — DRL § 170(7). No need to prove fault.
- Resolve all issues first: Custody, support, maintenance, equitable distribution, and counsel fees must be settled by written agreement or court decision before judgment.
- File the uncontested packet: Summons, complaint, settlement agreement, affidavits, and proposed judgment are filed in Supreme Court in the proper county (filing fees apply).
- Review & judgment: A judge reviews the papers; if complete, the Judgment of Divorce is signed without a court appearance in most truly uncontested cases.
Timing varies by county and court backlog. See our FAQ for residency and timeline basics.
